Chan Theary bail hearing scheduled for September 1

The Phnom Penh Appeal Court on September 1 is to hear the bail application of Cambodian-American political activist Seng Chan Theary, who is in prison after being found guilty of “plotting” and “incitement to foment serious chaos in society”.

Chan Theary’s lawyer Choung Choungy told The Post on August 30 that he will appear in court to argue her case – in her absentia – at the invitation of the prosecutor.

He said his client wanted to appear at the hearing but transport to the court could not be arranged as she is being detained in prison in Preah Vihear province.

“I, as a defence lawyer, have asked that the General Department of Prisons (GDP), under the Ministry of Interior, transfer her to Phnom Penh’s Correctional Centre II so that it would be easier for her to attend the hearing. But I have yet to receive a reply,” Choungy said.

GDP spokesman Nouth Savna could not be reached for comment on August 30.

The municipal court on August 14 sentenced Chan Theary to six years in prison for “plotting” under Article 453 of the Criminal Code and “incitement to foment serious chaos in society” under articles 494 and 495.

She was taken to prison in Preah Vihear province after the verdict was delivered.
